Not all assets require a probate procedure to pass them on to your heirs. In some cases, you may be able to avoid probate entirely. If the assets require probate to pay bills, transfer assets, and otherwise take care of legal matters after death, then we can discuss different types of probate. Florida Probate Law provides several different methods for handling a probate estate. If the estate does not qualify for Summary Administration, or other factors disfavor Summary Administration, then Formal Administration of the probate estate may be necessary. Individual cases depend upon the amount of assets, which assets are exempt, and will problems with creditors or other issues arise. In Summary Administration, the probate court does not appoint a personal representative. How Long Does Probate Take?
Probate administration may be fairly fast with Summary Administration, but not all estates qualify for Summary Administration. Depending upon the backlog of cases that the probate court administration must process, Summary Administration may take between one to three months, with some exceptions. In contrast, Formal Administration takes anywhere from five months to one year, with some exceptions. I have experience with Probate Courts in South Florida, Central Florida, and North Florida.
